California state law prohibits discrimination based on sexual orientation in the areas of employment, public accommodation and private and public employment. Sexual orientation discrimination in housing accommodation and employment is specifically addressed in the Cal Gov Code § 12920 (2001). Employment discrimination is also addressed in Cal Gov. Code § 12940 (2001). Sexual orientation is not specifically addressed in the California public accommodation law, the Unruh Civil Rights Act. Cal Civ Code § 51 (2001). California courts, however, have construed the code to include sexual orientation as a prohibited basis for discrimination.
